§ 50.99. PENALTY.

  • (A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
    (B) (1) Any person who violates any provision of §§ 50.20et seq., or violates any determination or order of the Board, shall be liable for a penalty not to exceed $2,500 per day of violation, which may be recovered in a civil action commenced in any court of competent jurisdiction by the Board.
    (2) Any person who violates any provision of §§ 50.20et seq. shall be deemed to have committed a misdemeanor and, on conviction thereof, shall be subject to a penalty of fine of not more than $2,500 for each violation.
    (C) (1) Any individual, person, corporation, or entity found to be in violation of the provisions of this chapter may be fined a sum not in excess of $2,500 per violation.
    (2) Should Boone County be required to seek injunctive relief from the Courts of Boone County for violations of this chapter, other than non-payment of fees required under § 50.33, they may seek an additional penalty of not less than $100 per day for each day the violation remains in existence and to seek further penalties of any sum up to a maximum of $500 per day for each day the violation continues to exist after injunctive relief is granted or other court-ordered requirements are imposed. The county shall be entitled to reimbursement of any reasonable attorney fees and costs of prosecuting such action under this chapter.
