§ 51.13. REMEDIES.

  • (A) The Health Officer may bring actions in the Boone County Circuit Court or Superior Court of Boone County for mandatory and injunctive relief for the enforcement of and to secure compliance with any order or orders made by the Health Officer or to otherwise provide for the enforcement of this subchapter.
    (B) Any such action for mandatory or injunctive relief may be joined with an action to recover the penalties, costs and expenses provided in this subchapter. In the event any legal action is necessary to enforce this subchapter, the Health Officer may seek recovery of costs and expenses reasonably incurred to enforce the provisions of this subchapter including, but not limited to, reasonable attorney's fees.
    (C) In addition to the specific enforcement mechanisms contained within this subchapter, the Health Officer may furnish written evidence of any violation of this subchapter to the Boone County Prosecutor and/or the Boone County Attorney for appropriate action against the offending person.
